1. Purpose of this manual
This manual explains how to request access to records held by Basterfield Engineering (Pty) Ltd ("Basterfield") and describes the records we hold. It also sets out the information required by section 51 of PAIA and the relevant provisions of the Protection of Personal Information Act 4 of 2013 ("POPIA").
PAIA gives a requester a right of access to a record of a private body when the record is required to exercise or protect a right, the procedural requirements have been met, and no ground of refusal applies.

3. The Information Regulator's PAIA Guide
The Information Regulator has published a guide under section 10 of PAIA to help people understand and exercise their rights under PAIA and POPIA. The guide explains how to make a request, the fees that may apply, the assistance available, and the remedies available when a request is refused or not answered.

6. Subjects and categories of records held
The inclusion of a category below does not mean that a requested record exists or that access will automatically be granted. Each request is considered under PAIA.

7. How to request access to a record
- Complete the prescribed Form 2: Request for Access to Record (PDF).
- Describe the requested record in enough detail for Basterfield to identify it. Identify the right you seek to exercise or protect and explain why the record is required for that purpose.
- State the form of access you require and provide your contact details. If you make a request for another person, include proof of the capacity in which you act.
- Send the completed form and supporting documents to hello@basterfield.co.za or deliver them to the physical address in section 2.
Basterfield will ordinarily notify you of its decision within 30 days after receiving a valid request. PAIA permits this period to be extended once by up to 30 further days in specified circumstances. Access may be refused on a ground set out in PAIA, including grounds protecting privacy, confidential commercial information, safety, privileged records and research information.
Fees
The prescribed request, search, preparation, reproduction and delivery fees may apply. If a fee or deposit is payable, Basterfield will notify you before processing or releasing the record. See the Information Regulator's current PAIA fee structure.
8. Remedies if a request is refused or unanswered
There is no internal appeal against a decision of a private body. A requester or affected third party may lodge a complaint with the Information Regulator within 180 days of the decision or deemed refusal, using Form 5: Complaint Form (PDF). Complaints may be submitted to PAIAComplaints@inforegulator.org.za. A requester or affected third party may also seek relief from a court in accordance with PAIA.
9. Processing of personal information
9.1 Purposes of processing
Basterfield processes personal information to manage enquiries and customer relationships; provide quotations, products, delivery, warranties and support; manage suppliers and other business relationships; recruit and administer employees; comply with tax, employment, safety and other legal obligations; operate and secure its premises, systems and website; communicate and market where permitted; prevent fraud and manage risk; and establish, exercise or defend legal claims.

9.4 Transborder flows of personal information
Basterfield may use cloud, technology or other service providers that process information outside South Africa. Where personal information is transferred to another country, Basterfield will do so only where permitted by section 72 of POPIA and will use appropriate contractual, organisational or other safeguards.
9.5 Information-security measures
Basterfield uses reasonable and appropriate technical and organisational safeguards based on the nature of the information and the risks involved. These may include role-based access, authentication controls, secure configuration, malware protection, backups, physical security, confidentiality obligations, service- provider controls, staff awareness, monitoring, incident response and secure disposal. Safeguards are reviewed and updated as risks and business needs change.
10. Availability and updates
This manual is available free of charge on this website and for public inspection during normal business hours at Basterfield's physical address. A copy may also be requested from the Information Officer and will be provided subject to any prescribed reproduction or delivery fee. It will be supplied to the Information Regulator on request.
The Information Officer will review this manual regularly and update it when material information or legal requirements change.
